Article 43For units and personnel who have made significant achievements in emergency plan management,Safety Production Supervision and Management DepartmentEmergency management departments of people's governments at all levelsProduction and business units can be commended and rewarded.  

Article 44If a production and operation unit falls under any of the following circumstances, it shall be handled by the county-level or above authoritiesSafety Production Supervision and Management DepartmentEmergency management departments of the People's GovernmentAccording to Article 94 of the Work Safety Law of the People's Republic of China, it is ordered to make corrections within a specified time limit and may be fined up to 50000 yuan; Those who fail to make corrections within the prescribed time limit shall be ordered to suspend production and business for rectification, and shall be fined not less than 50000 yuan but not more than 100000 yuan. The directly responsible person in charge and other directly responsible personnel shall be fined not less than 10000 yuan but not more than 20000 yuan:

（1） Failure to prepare emergency plans in accordance with regulations;

（2） Failure to regularly organize emergency plan drills in accordance with regulations.

Article 45If a production and operation unit falls under any of the following circumstances, it shall be handled by the county-level or above authoritiesSafety Production Supervision and Management DepartmentEmergency Management Department of the People's GovernmentOrdered to rectify within a specified time limit, a fine of not less than 10000 yuan but not more than 30000 yuan may be imposed:

（1） Failure to carry out risk management in accordance with regulations before the preparation of emergency plansIdentificationAssessment and investigation of emergency resources;

（2） Failure to conduct emergency plan review or argumentation in accordance with regulations;

（3） Failure to file emergency plans in accordance with regulations;

（fourthree）Failure to inform surrounding units and personnel of the nature, scope of impact, and emergency prevention measures of accident risks that may affect them;

（fivefour）Failure to conduct emergency plan evaluation in accordance with regulations;

（sixfive）Failure to revise emergency plans in accordance with regulationsAnd re registerof

（sevensix）Failure to implement emergency supplies and equipment as stipulated in the emergency plan.

If a production and business unit fails to register its emergency plan in accordance with regulations, the emergency management department of the people's government at or above the county level shall, in accordance with its responsibilities, order it to make corrections within a specified period of time; For those who fail to make corrections within the prescribed time, a fine of not less than 30000 yuan but not more than 50000 yuan shall be imposed, and the directly responsible supervisors and other directly responsible personnel shall be fined not less than 10000 yuan but not more than 20000 yuan.  

Article 46The "Application Form for Filing Emergency Plans for Production Safety Accidents of Production and Business Units" and the "Registration Form for Filing Emergency Plans for Production Safety Accidents of Production and Business Units" are submitted byNational Safety Production Emergency Rescue Command CenterEmergency Management DepartmentUnified formulation.

Article 47Provinces, autonomous regions, and municipalities directly under the central governmentSafety Production Supervision and Management DepartmentEmergency Management Department of the People's GovernmentImplementation rules can be formulated based on the provisions of these measures and the actual situation in the local area.

Article 48The management of emergency plans for safety accidents in scientific research institutions, schools, hospitals, and other units that store and use flammable and explosive materials, hazardous chemicals, and other hazardous materials shall be carried out in accordance with the relevant provisions of these Measures.
