Chapter 1 General Provisions

Article 1In order to standardize the management of emergency plans for production safety accidents and quickly and effectively handle production safety accidents, in accordance with the "Emergency Response Law of the People's Republic of China" and the "Safety Production Law of the People's Republic of China"Regulations on Emergency Response to Production Safety AccidentsWaiting for the lawAdministrative regulationsThis method is formulated in accordance with the "Management Measures for Emergency Response Plans for Sudden Incidents" (Guobanfa [2013] No. 101).


Article 2The preparation, review, publication, and filing of emergency plans for production safety accidents (hereinafter referred to as emergency plans)Promotion, education, training, drills, evaluation, and revisionimplementationThis method shall apply to the supervision and management work.

Article 3The management of emergency plans follows the principles of territorial priority, hierarchical responsibility, classified guidance, comprehensive coordination, and dynamic management.

Article 4  State Administration of Work SafetyEmergency Management DepartmentResponsible for the comprehensive coordination and management of national emergency plans.Other departments of the State Council responsible for safety production supervision and management shall be responsible for the management of emergency plans in relevant industries and fields within their respective areas of responsibility.

Local governments at or above the county levelSafety Production Supervision and Management DepartmentEmergency Management Department of the People's GovernmentResponsible for the comprehensive coordination and management of emergency plans within the administrative region. Local governments at or above the county levelThe People's GovernmentOther departments responsible for safety production supervision and management shall be responsible for the management of emergency plans in relevant industries and fields according to their respective duties.

Article 5The main person in charge of the production and operation unit is responsible for organizing the preparation and implementation of the unit's emergency plan, and is responsible for the authenticity and practicality of the emergency plan; Each responsible person in charge shall implement the responsibilities stipulated in the emergency plan according to their respective duties.

Article 6Emergency plans for production and operation units are divided into comprehensive emergency plans, special emergency plans, and on-site disposal plans.

Comprehensive emergency plan refers to the comprehensive work plan formulated by production and operation units to respond to various production safety accidents. It is the overall work procedure, measures, and emergency plan system for the unit to respond to production safety accidents.

Special emergency plan refers to a specialized work plan developed by production and operation units to respond to one or more types of production safety accidents, or to prevent production safety accidents for important production facilities, major hazard sources, and major activities.

On site disposal plan refers to the emergency response measures formulated by production and operation units for specific locations, installations, or facilities based on different types of production safety accidents. 



Chapter 2Preparation of emergency plan

Article 7The preparation of emergency plans should follow the principles of putting people first, complying with laws and regulations, being practical, and focusing on effectiveness. With emergency response as the core, emergency responsibilities should be clarified, emergency procedures should be standardized, and safeguard measures should be refined.

Article 8The preparation of emergency plans should meet the following basic requirements:


(1) Provisions on laws, regulations, rules, and standards;

(2) The actual situation of safety production in this region, department, and unit;

(3) Hazard analysis of the local area, department, and unit;

(4) The division of responsibilities between emergency organizations and personnel is clear, and there are specific implementation measures in place;

(5) There are clear and specific emergency procedures and response measures that are compatible with their emergency capabilities;

(6) There are clear emergency measures in place to meet the emergency needs of the local area, department, and unit;

(7) The basic elements of the emergency plan are complete and complete, and the information provided in the emergency plan attachments is accurate;

(8) The content of the emergency plan is interconnected with the relevant emergency plans.

Article 9A working group should be established to prepare emergency plans, with the relevant person in charge of the unit serving as the group leader, and personnel from functional departments and units related to emergency plans, as well as personnel with on-site disposal experience, should participate.

Article 10Before preparing an emergency plan, the compiling unit should conduct an accident risk assessmentIdentificationAssessment and investigation of emergency resources.

Accident riskIdentificationAssessment refers to the process of identifying the existing hazardous factors for different types and characteristics of accidents, analyzing the possible direct, secondary, and derivative consequences of accidents, evaluating the degree of harm and scope of impact of various consequences, and proposing measures to prevent and control accident risks.

Emergency resource investigation refers to a comprehensive investigation of the emergency resource status that can be mobilized by the local area and the unit in the first time, as well as the emergency resource status that can be requested for assistance within the cooperation area, combined with the risk of accidentsidentificationThe process of evaluating conclusions and formulating emergency measures.

Article 11Local levelsSafety Production Supervision and Management DepartmentEmergency management departments of the people's government and other departments responsible for safety production supervision and managementIt should be based on laws, regulations, rules, and the same level of people's government as well as the higher levelSafety Production Supervision and Management DepartmentEmergency management departments of the people's government and other departments responsible for safety production supervision and managementOrganize the preparation of corresponding departmental emergency plans based on the actual work situation.

The departmental emergency plan should clarify information reporting, response grading, command authority transfer, and alert evacuation based on the actual situation of the local area and department.

Article 12Production and business units shall, in accordance with relevant laws, regulations, rules, and standards, combine their organizational management system, production scale, and potential accident characteristics,Maintain connection with relevant contingency plans,Establish an emergency plan system for our unit, prepare corresponding emergency plans, and reflect the characteristics of self rescue, mutual assistance, and early disposal.

Article 13Production and operation units with multiple types of risks and the possibility of multiple types of accidents should organize the preparation of comprehensive emergency plans.

The comprehensive emergency plan shall specify the emergency organization and its responsibilities, emergency plan system, accident risk description, warning and information reporting, emergency response, safeguard measures, emergency plan management, and other contents.

Article 14For one or more types of accident risks, production and operation units can develop corresponding special emergency plans or integrate special emergency plans into comprehensive emergency plans.

The special emergency plan shall specify the emergency command organization and responsibilities, disposal procedures and measures, etc.

Article 15For places, installations or facilities with high risks, production and operation units shall prepare on-site disposal plans.

The on-site disposal plan should specify emergency work responsibilities, emergency response measures, and precautions.

Production and operation units with single accident risk and low danger can only prepare on-site disposal plans.

Article 16The emergency plan of production and operation units shall include the content to be reported to the higher-level emergency management agency, the contact information of the emergency organization and personnel, the list of emergency material reserves and other attachment information. When there are changes in the attachment information, it should be updated in a timely manner to ensure accuracy and effectiveness.

Article 17In the process of preparing emergency plans for production and operation units, opinions from relevant emergency rescue teams, citizens, legal persons, or other organizations should be solicited in accordance with the provisions of laws, regulations, rules, or actual needs.

Article 18The various emergency plans prepared by production and operation units should be interconnected and linked with the emergency plans of relevant people's governments and their departments, emergency rescue teams, and other units involved.

Article 19Production and business units shall, based on the preparation of emergency plans, develop concise, practical, and effective emergency response cards according to the characteristics of the workplace and position.

The emergency response card should specify the emergency response procedures and measures for key positions and personnel, as well as the relevant contact persons and contact information, for the convenience of practitioners to carry.
